Derek P. Cole

Derek Cole is a co-founder of Cota Cole & Huber LLP and specializes in municipal law. He serves as City Attorney for the Cities of Oakley, Sutter Creek, and Angels Camp, and previously served as Interim City Attorney for the City of Antioch (2015-2016) and as County Counsel for the County of Trinity (2008-2013). Mr. Cole also devotes a significant portion of his practice to litigation, handling a diverse caseload before state and federal courts and a wide variety of administrative forums.

Although Mr. Cole is familiar with all aspects of municipal government, he specializes in land use and environmental law. He is very experienced in matters concerning CEQA, local planning and zoning requirements, development agreements, the Subdivision Map Act, the Surface Mining and Reclamation Act, Williamson Act, CERCLA, and air and water quality laws.

Mr. Cole was named as a “Super Lawyer” in the 2015 and 2016 editions of Northern California Super Lawyers magazine; was named as a “Top Lawyer” in Sacramento magazine in 2015 and 2016; and was honored by the Sacramento Business Journal with “Best of the Bar” awards in 2014 and 2016.

Mr. Cole is a frequent writer on a wide range of legal subjects. He is the author of California Surface Mining Law (Solano Press Books, 2009), a number of articles in various legal publications, and several blogs in the California Municipal Law Blog, for which he is the chief contributor. Mr. Cole is also active on social media (Twitter: @derekpcole) regarding local government topics.

Mr. Cole co-founded Cota Cole & Associates (now Cota Cole & Huber LLP) with partners Dennis Cota and Scott Huber in January 2007. Between 2004 and 2007, Mr. Cole worked in the Sacramento office of the statewide law firm, Best Best & Krieger LLP, where his practice focused on municipal and environmental litigation. Between 1999 and 2004, Mr. Cole was an associate attorney at Taylor & Wiley, a Sacramento firm, where his practice focused on land use entitlements and environmental compliance.

Mr. Cole graduated with distinction from the University of the Pacific, McGeorge School of Law in 1999. At McGeorge, Mr. Cole was admitted to the Order of the Coif, Order of Barristers, and Traynor Honor Society. He was also a member of the Editorial Board of the McGeorge Law Review and published two student comments in that journal. Prior to attending law school, Mr. Cole graduated from the University of California at Santa Barbara in 1996 with a Bachelor of Arts degree in Law and Society.
